Section 13 declared 'unconstitutional'!

CHRC Tribunal chair Athanasios Hadjis has ruled that Section 13, Canada's much maligned human rights hate speech law, is unconstitutional, and a violation of the Charter right to free expression.

I have also concluded that s. 13(1) in conjunction with ss. 54(1) and (1.1) are inconsistent with s. 2(b) of the Charter, which guarantees the freedom of thought, belief, opinion and expression. The restriction imposed by these provisions is not a reasonable limit within the meaning of s. 1 of the Charter.

Mark Steyn says it's the 'beginning of the end' for section 13, and a major boost to the fight that he, Ezra Levant and MacLean's magazine have been waging!

And this hilarious poem is quoted in the chair's decision, I had never heard it before. Racist? No! Hateful? Again, No? Funny? I certainly thought so!

Canadian Immigrant Poem

I cross ocean,
poor and broke,
Take bus,
see employment folk.

Nice man treat me
good in there,
Say I need to
see welfare.

Welfare say,
"You come no more,
We send cash
right to your door."

Welfare cheques,
they make you wealthy,
Medicare it keep
you healthy!

By and by,
I got plenty of money,
Thanks to you,
Canadian dummy.

Write to friends
in motherland,
Tell them `come
fast as you can.'

They come in turbans
and Ford trucks,
I buy big house
with welfare bucks

They come here,
we live together,
More welfare cheques,
it gets better!

Fourteen families,
they moving in,
But neighbor's patience,
wearing thin.

Finally, white chap
moves away,
Now I buy his house,
and then I say,

"Find more aliens
for house to rent."
And in the yard
I put a tent.

Send for family
they just trash,
But they, too,
draw the welfare cash!

Everything is
very good,
And soon we
own the neighbourhood.

We have hobby - -
it's called breeding,
Welfare pay
for baby feeding.

Kids need dentist?
Wife need pills?
We get free!
We got no bills!

Canadian crazy!
He pay all year,
To keep welfare
running here.

We think Canada
damn good place!
Too damn good for
the white man race.

If they no like us,
they can scram,
Got lots of room in

  1. Here's the problem Don. This was actually a CHRC victory, pulled it out in the shootout. Declared Lemire guilty, just didn;t give the trophy to Warman and the CHRC.

Besides, Hadjis has no power to call S 13 unconstitutional, which means that his own ruling can be overturned, and he probably knows that too. It takes a real court with a real judge to make that call.

This ain't over. It is just starting. Hold off on the Kool Aid until we see a real decision, like maybe Boissoin at Alberta Court of Queens Bench coming up later this month.

  2. You're right, this fight isn't over.
